At the time, Desjardins was plotting to kill Mafioso Salvatore 'The Ironworker' Montagna. On Sept. 16, 2011, someone from Montagna’s side tried to act first in their conflict to control the Montreal Mafia. Desjardin's group killed Montagna two months later.

|Mignacca argued the sentence was unreasonable. The Crown had recommended a five-year prison term. The maximum potential sentence Mignacca faced was 14 years.|
Desjardins was in his BMW, discussing something with Mignacca, who was in another vehicle, when a gunman emerged from a wooded area off the shore of Rivière des Prairies and opened fire. Desjardins drove off and Mignacca pulled out a handgun and fired off several shots in return from the driver’s seat of his vehicle, which had stalled because the engine was damaged by gunfire.
